01 Acceptance of Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”, “your”) and DailyFirst EdTech Pvt. Ltd. (“Company”, “we”, “us”, “our”), governing your use of the NEET DailyFirst website at neet.dailyfirst.in and related mobile applications and services (collectively, the “Platform”).

If you are a minor (under 18 years), these Terms must be read and accepted by your parent or legal guardian on your behalf. Their use of the Platform on your behalf constitutes acceptance of these Terms.

02 Eligibility

To use NEET DailyFirst, you must:

• Be a resident of India
• Be at least 13 years of age (users under 18 require parental consent)
• Provide accurate and truthful information during registration
• Not be previously banned or suspended from our Platform
• Have the legal capacity to enter into binding agreements (or have parental consent)

We reserve the right to verify eligibility at any time and to deny or revoke access if eligibility requirements are not met.

03 Your Account

3.1 Account Registration

You must register for an account to access most features of the Platform. You agree to provide accurate, current, and complete information and to update this information as needed.

3.2 Account Security

• You are responsible for maintaining the confidentiality of your login credentials
• You must not share your account with any other person
• You must notify us immediately at support@dailyfirst.in if you suspect unauthorised access
• We are not liable for losses resulting from unauthorised account access due to your failure to secure your credentials

3.3 One Account Per Person

Each individual student or user may maintain only one active account. Creating multiple accounts to circumvent restrictions or policies is strictly prohibited and may result in all accounts being terminated.

04 Our Services

4.1 Free Services

Free users receive limited access including a set number of daily questions and one mock test per month. Free features may be modified or discontinued at our discretion with reasonable notice.

4.2 Paid Subscription Services

Pro and Yearly plan subscribers receive full access to all features as described on our pricing page at the time of purchase. Specific features are subject to change with at least 14 days’ notice to active subscribers.

4.3 Service Availability

We aim for 99.5% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance. We are not liable for losses due to unavailability outside our control.

05 Payments & Refund Policy

5.1 Pricing

All prices are listed in Indian Rupees (INR) and include applicable GST. We reserve the right to change prices at any time; such changes will not affect active subscriptions until renewal.

5.2 Payment Processing

Payments are processed by Razorpay, a PCI-DSS compliant payment gateway. We do not store your card or payment instrument details. By making a payment, you agree to Razorpay’s terms of service.

5.3 Refund Policy

• 7-Day Refund Window: If you are not satisfied, request a full refund within 7 days of your first purchase for that plan. No questions asked.
• Refunds are not available after the 7-day window unless the Platform was completely inaccessible for more than 48 consecutive hours.
• Refunds are processed to the original payment method within 5–7 business days.
• If you received a special promotional discount exceeding 30%, refunds may be subject to deduction of the discount value.
• Free trial abuse (repeatedly purchasing and refunding) will result in account termination.

06 Intellectual Property

6.1 Our Content

All content on the Platform — including but not limited to questions, explanations, video lectures, graphics, logos, interface design, and text — is the exclusive property of DailyFirst EdTech Pvt. Ltd. or its content partners. This content is protected under the Copyright Act, 1957 and other applicable intellectual property laws.

6.2 License to You

We grant you a personal, non-exclusive, non-transferable, limited licence to access and use the Platform solely for your own personal, non-commercial educational preparation.

6.3 Your Content

Any feedback, suggestions, or content you submit to us (such as doubt questions) grants us a non-exclusive, perpetual, royalty-free licence to use, modify, and publish that content for educational purposes on the Platform.

07 Acceptable Use & User Conduct

You agree not to use the Platform for any of the following:

• Sharing, distributing, or selling any Platform content outside your personal use
• Using automated tools (bots, scrapers, scripts) to access, download, or harvest content
• Attempting to breach the security of the Platform or any user account
• Impersonating any person or entity, or providing false information
• Posting abusive, offensive, or defamatory content in any community features
• Engaging in academic dishonesty or helping others cheat in tests
• Using the Platform for commercial purposes without written permission
• Attempting to reverse engineer, decompile, or extract the source code of our applications
• Any activity that violates applicable Indian law or regulations

We reserve the right to investigate and take appropriate action, including account suspension or termination, for violations of this section.

08 Disclaimers

The Platform and all content are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

While we strive for content accuracy, we do not warrant that all questions and explanations are free from errors. Please report any errors to content@dailyfirst.in.

09 Limitation of Liability

To the maximum extent permitted by applicable law, DailyFirst EdTech Pvt. Ltd. and its officers, directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of data, profit, goodwill, or business opportunity
• Damages arising from your inability to access or use the Platform
• Errors in educational content or test questions
• Any matters beyond our reasonable control

Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the 3 months preceding the claim. This limitation does not apply to liability that cannot be excluded under law.

10 Termination

10.1 By You

You may delete your account at any time by going to Settings → Account → Delete Account, or by emailing support@dailyfirst.in. Deleting your account cancels your subscription and forfeits any remaining subscription period (no refund for partial periods beyond the 7-day window).

10.2 By Us

We may suspend or terminate your account immediately, without prior notice, if you:

• Violate any provision of these Terms
• Engage in fraudulent activity or abuse our refund policy
• Share, distribute, or misuse our content
• Provide false registration information
• Harass other users or our support staff

Terminated accounts are not eligible for refunds unless the termination was due to our error. We will provide a written reason for termination where required by law.

11 Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, including:

• The Information Technology Act, 2000 and IT (Amendment) Act, 2008
• The Consumer Protection Act, 2019
• The Digital Personal Data Protection Act, 2023
• The Indian Contract Act, 1872

The courts at Bengaluru, Karnataka shall have exclusive jurisdiction over all disputes arising from these Terms.

12 Dispute Resolution

In the event of any dispute, claim, or controversy arising from these Terms:

1. Step 1 – Internal Resolution: Contact our support team at support@dailyfirst.in. We aim to resolve all disputes within 15 working days.
2. Step 2 – Mediation: If unresolved, the parties agree to attempt mediation through an agreed mediator in Bengaluru before proceeding to legal action.
3. Step 3 – Legal Action: If mediation fails, disputes shall be resolved through the appropriate courts in Bengaluru, Karnataka.

Consumers may also approach the relevant Consumer Disputes Redressal Forum under the Consumer Protection Act, 2019.

For grievances under the IT Act, 2000, you may contact our Grievance Officer at the address above. We acknowledge grievances within 24 hours and resolve them within 30 days.

We may update these Terms from time to time. Continued use of the Platform after changes constitutes acceptance of the updated Terms. We will notify registered users by email for significant changes.
